At SidelineSwap, we take the sale of counterfeit items extremely seriously. The manufacturing and sale of counterfeit goods is illegal and violates intellectual property rights. This policy outlines our approach to handling counterfeit claims and protecting our community.
What is a Counterfeit Item?
A counterfeit item is any product that is made to imitate an authentic item without authorization from the brand owner. This includes unauthorized replicas of branded equipment, apparel, or accessories that are passed off as genuine products.
For Buyers
Filing a Dispute on SidelineSwap
If you believe you've received a counterfeit item:
- Open a dispute within 72 hours of receiving your item on SidelineSwap
- Provide clear evidence supporting your counterfeit claim
- Provide counterfeit verification from the brand manufacturer
- Do not alter, use, or damage the item while the dispute is being investigated
Note: While the 72-hour window is strict, we may make exceptions for counterfeit claims in certain circumstances, provided the item remains unused.
Evidence Requirements
Accepted evidence of counterfeiting may include:
- Authentication from the brand manufacturer
- Detailed photos showing specific signs of counterfeiting
- Comparison photos with authentic items
- Professional authentication documentation
For Sellers
First Counterfeit Violation
We understand that sellers may unknowingly acquire counterfeit items. For first-time violations, we may restore account access if the seller:
- Proves the incident was isolated and unintentional
- Provides valid receipts for their inventory
- Removes all potentially counterfeit items from their listing
- Demonstrates understanding of how to verify authentic items
For Sellers
First Counterfeit Violation
We understand that sellers may unknowingly acquire counterfeit items. For first-time violations, we may restore account access if the seller:
- Proves the incident was isolated and unintentional
- Provides valid receipts for their inventory
- Removes all potentially counterfeit items from their listing
- Demonstrates understanding of how to verify authentic items
Second Counterfeit Violation
A second verified counterfeit violation results in:
- An indefinite account restriction at minimum, often leading to a complete ban/removal from the platform
- Funds from existing sales held for a minimum of 12 months from last delivery
Important Notes for Sellers
- Sellers are not entitled to funds from counterfeit sales
- Release of funds from counterfeit sales is at SidelineSwap's sole discretion
- Sellers are responsible for verifying the authenticity of their items before listing
- Repeated violations may result in legal action
